What is rural land and how is it classified?
In the province of Málaga, land is mainly classified as:
-
Urban
-
Building land
-
Non-developable (rural)
The rural or non-developable land is intended for environmental protection and agricultural, forestry or livestock uses. Large-scale development isn't allowed, but there are exceptions that allow homes to be built or installed under strict conditions.
Under current Andalusian regulations, mainly the Andalusian Land Sustainability Act (LISTA) and its regulations, rural land can be divided into:
-
Common rural land: no special protection.
-
Protected rural land: for environmental, cultural or landscape values.
Can you build on rural land in Málaga?
Yes, you can build on common rural land, but under strict conditions. You must meet a series of technical, planning and legal requirements.
Requirements for building a detached home on rural land:
-
Minimum plot size: 25.000 m².
-
Building density: 1 home per property.
-
Maximum built area: 1% of the land area (for example, on a 25,000 m² property you could build up to 250 m²).
-
Maximum height: 2 floors.
-
Minimum distance to boundaries: 25 metres.
-
Minimum distance between homes: 100 metres.
-
Must not form a settlement.
-
Located outside flood-risk or high-risk forest areas.
-
Self-sufficient water, sanitation and energy systems (preferably renewable).
Procedure for building legally:
-
Planning compatibility report (requested from the Town Council).
-
Action Project (drawn up by an architect and approved by the Town Council).
-
Building permit once the project is approved.
-
Registration at the Land Registry and Cadastre once built.
Important: you cannot build on protected rural land, except in exceptional cases (agricultural infrastructure or public facilities).
What if I want to put a prefabricated house or mobile home on it?
The prefabricated houses, modular homes o mobile homes are an attractive option thanks to their quick installation, lower cost and energy efficiency. However, their legality depends on its use, type of installation and permanence.
What does the law say about prefabricated houses on rural land?
There are two situations:
1. Prefabricated house anchored to the ground (residential use)
If the house:
-
Is anchored to the ground,
-
Has fixed water, electricity or sewage connections,
-
And is used as a main residence,
Then it is considered a building y and must follow the same procedure as any construction on rural land:
✔ Technical project
✔ Action Project
✔ Building permit
✔ First occupation licence
If it doesn't meet the requirements for size, use, location or permits, it can be fined or even demolished.
2. Mobile home not anchored to the ground
If the installation:
-
Isn't anchored to the ground,
-
Can be easily removed,
-
Has no foundations or fixed works,
-
And is considered mobile and temporary,
Can not be considered a building and therefore not need a planning permit. But it may require authorisation from the Town Council and must be on land compatible with that activity.
Professional tip: even if it isn't anchored, town councils often require prior authorisation or a rural activity licence, especially if there's an electricity or wastewater connection.
How do you legalise a house already built on rural land?
New Andalusian legislation allows older homes to be regularised under certain conditions:
-
They must have been built before 1 January 2021.
-
They cannot be on specially protected land.
-
They cannot be subject to enforcement proceedings.
-
They require a technical certificate and environmental compliance.
This process is known as Declaration of Non-Conforming Status (DAFO), and lets you register the home, connect utilities and have legal cover, although it doesn't grant all planning rights.
Associated taxes and costs
Building or installing a house (prefabricated or not) on rural land involves several legal costs:
-
Planning report fee.
-
Technical fees (architect, surveyor).
-
Action Project: approx. €1,000 to €4,000.
-
Building permit and ICIO tax.
-
Registering the home.
-
Rural or urban IBI (depending on legal status).
A municipal financial compensation may also be required for residential use of rural land.
