Bare ownership
What is bare ownership?
It is a person's right to own an asset with the limitation of not being able to use or enjoy it, since its use and possession belong to a third party (the usufructuary).
What powers does the bare owner have over the asset?
According to Article 489 of the Spanish Civil Code, the bare owner can dispose of it (sell it), but this will not affect the usufruct, which remains in place; as a general rule, the bare owner may not do anything that harms the usufructuary.
How is bare ownership transferred?
As a property right, bare ownership is acquired either through any act between living persons, such as a sale or gift, or on death, through succession.
How is the value of bare ownership calculated?
The value of the bare ownership is calculated by subtracting the value of the usufruct from the total value of the flat; the usufruct value usually depends on the usufructuary's age.
For example:
If a flat is worth €200,000 and the usufructuary is 75, the usufruct is worth 14%. So we subtract 14% from €200,000.
The calculation isn't always exact, though: if the usufructuary is very young, the home may not sell because the buyer couldn't use it for many years, and most investors don't make such long-term investments.
Sell bare ownership
Sell your bare ownership quickly and easily. Once we've studied your case, we'll present you with a formal purchase offer in a short time. We have a large portfolio of buyers interested in buying the bare ownership of homes in Málaga.

What does selling bare ownership mean?
It means transferring only the part of the home that makes up the bare ownership; the usufruct part is not transferred.
Can you sell bare ownership?
Yes, without any problem.
As a general rule, bare ownership is sold for cash, since the buyer needs the usufructuary's permission to mortgage the home.
How is bare ownership sold?
Like any normal sale. Both parties, buyer and seller, must attend the signing before the notary to formalise the deed, and each must pay their own taxes and costs.

Can you sell a flat with usufruct?
Yes, without any problem. In this case the seller transfers only the bare ownership and the usufructuary keeps the usufruct for life.

How do you sell a flat with usufruct?
Like a normal sale, except that only a percentage of the home is transferred, as another percentage belongs to the usufructuary.
If the new owner wants full ownership of the home, they'll have to buy the usufruct or wait until the usufructuary dies.

What is usufruct?
Usufruct is the right to use and enjoy someone else's property.
What rights does usufruct give?
A usufruct gives the right to enjoy another person's property with the obligation to preserve its form and substance, unless the title creating it or the law provides otherwise.
Article 467 of the Spanish Civil Code
The holder of this right is called the usufructuary; the owner cannot use the property because they do not hold the right of usufruct.
The usufructuary can enjoy the property for as long as the usufruct lasts. They cannot dispose of the property itself, but they can dispose of their right of usufruct, rent it out and receive the rent. Under no circumstances can they sell the home (because it isn't theirs), but they can sell their right of usufruct over it. In that case, the buyer acquires the right of usufruct with the same benefits and obligations as the
selling usufructuary.
On the other hand, the holder of ownership of the property subject to usufruct is called the bare owner, who
